Saving on a lawyer: consequences
A client contacted FINCOM group lawyers with a request to resolve a dispute that arose as a result of receiving improperly packaged goods from a supplier.
The company was considering to lay a cable at the bottom of a river, however, the materials received did not meet their expectations. According to our client, the cable should be supplied wound on a drum, but this condition was not fulfilled. The supplier referred to the absence of relevant provisions in the contract and asked the client to sign the acceptance certificate.
During analysis of the documents, FINCOM group experts found out that the provisions of the contract and invoice have no requirements regarding the way of supplying the cable. An additional review of GOSTs showed that the supplier had a right to supply the cable in any form: either wound on a drum or in coils. Besides, we found out that changing the winding method could negatively affect the quality of the quality.
FINCOM group experts took all necessary steps to resolve the conflict in favor of our client. Considering that the trial could require significant amount of time and money, we suggested more economically sound solutions. As a result, the conflict was resolved with minimal financial costs through return and resupply of the cable according to the clients’ wishes.
