Enforcement proceedings
FINCOM group provides services on support of individuals and legal entities during enforcement proceedings at all stages.
Our company’s employees will assist you in obtaining an order of enforcement and further execution of the court order. This service can be provided either by sending the order to credit institutions (with further supervision of its execution) or by working in direct contact with the authorities executing the court orders and other enforcement documents by law.
Support in enforcement proceedings includes the following:
consultations on execution of court orders
conducting negotiations on voluntary execution of a court order
obtaining an order of enforcement (or its duplicate) and filing it to the Court Bailiffs Service
sending the order of enforcement to the debtor’s bank to collect the debt without notice, or to the Court Bailiffs Service for its compulsory enforcement at the expense of the debtor’s money and property
preparation of documents on postponement or installment of a court order execution, on changing the way of and procedure for its execution
representation in court on postponement or installment of a court order execution, on changing the way of and procedure for its execution
assessment of the prospects of enforcement proceedings, search for information on the debtor in open sources
drawing up a plan of enforcement procedures: control over the arrest, assessment, accounting and sale of arrested and seized property of the debtor
checking the legality and evaluating the bailiff’s actions; challenging their actions or inaction, if necessary
control over execution of the submitted enforcement document, including review of the materials of enforcement proceedings
implementation of efficient measures for tracing the debtor’s assets
